Policy Limits Settlement For Passenger Not Wearing Seatbelt
New Jersey Super Lawyer Edward Kasselman recovered $100,000 for a 25 year old passenger not wearing his seatbelt. Defendant driver swerved to avoid hitting a deer, and struck a mailbox and concrete barrier. Plaintiff had facial fractures; the insurance company tried to deny the claim because plaintiff wasn’t wearing his seatbelt. Mr. Kassleman was able to prove that the crash was severe enough that serious injuries were likely even without the seatbelt, and he persuaded the driver’s insurance company to pay their full policy limits of $100,000.
