Liberty Ammunition Obtains Verdict Against United States In Patent Infringement Litigation
Bathgate, Wegener & Wolf and co-counsel successfully represented Liberty Ammunition, an American startup company, that patented environmentally sensitive ammunition in a patent infringement suit against the United States of America. The primary rifle ammunition used by the U.S. Army was held to infringe upon Liberty Ammunition’s 2010 patent. Liberty Ammunition obtained a judgment of approximately $17,000,000 for past damages and interest, which is the largest patent infringement verdict against the United States in over 15 years. Additionally, the Court awarded Liberty Ammunition ongoing royalty damages that will likely result in further damages exceeding $85,000,000. Hard fought federal litigation spanning more than 5 years, extensive discovery, wide-ranging motion practice and appellate practice resulted in this important intellectual property victory for Liberty Ammunition and an award of potentially $100,000,000.
