Immigration law involves the rules established by the United States in determining who may enter the country and for what purpose, the reasons that a foreign national is permitted to enter, what the foreign national may do and how long he can stay in the United States, and the consequences faced by a foreign national for violating the law. This area of the law is exceedingly complex and touches upon many diverse issues. Immigration policy and practices are more fluid today than at any time in the history of the United States. People from foreign countries obtain permission to come to the United States through the issuance of visas. One who wants to reside permanently in the United States seeks a visa to make him a “lawful permanent resident,” that is, an “LPR”. This visa is commonly referred to as a “green card.” An immigrant may become an LPR because a sponsoring family member is a citizen, or the immigrant has a particular employment or athletic skill, or is subject to religious or ethnic persecution in his native country, or is chosen for immigration as part of the diversity random selection process. LPRs are eligible to become citizens of the Unites States. Other visas are issued for temporary stays to enable the foreign national to work, attend school, or visit for tourism.
A foreign national who comes to the Unites States without a visa, or has overstayed the term of the visa, or has engaged in some conduct that may threaten his legal status may face serious legal consequences including detention and deportation. Those who are in the United States without visas or have overstayed their visas have rights under United States law. Becoming a citizen also involves a complex legal process.
