Victoria R. Emanuele has been appointed as Municipal Prosecutor for the Borough of Point Pleasant for the second consecutive year. Brian W. Appellate Court Affirms Walmart Approval
On June 13, 2011, the Superior Court of New Jersey, Appellate Division, released, and approved for publication, its decision in Shakoor Supermarkets, Inc. v. Old Bridge Township Planning Board. In that opinion, the Appellate Division affirmed the rulings of the trial court which affirmed the decision of the Old Bridge Planning Board to grant preliminary and final major site plan approval, together with variances and waivers  to a 230,000 square foot retail, restaurant and office complex in Old Bridge, Middlesex County, New Jersey  That project included a 150,000 square foot Walmart and a 7,200 square foot garden center. See Shakoor Supermarkets, Inc. v. Marlboro And Aberdeen Farmland Preserved For Open Space
William J. Wolf, a partner with the law firm of Bathgate Wegener & Wolf, P.C., with offices in Ocean County, New Jersey represented the Estate of Eugene Fariello in a two phase land preservation and open space transaction involving 70.74 acres in Aberdeen and Marlboro, Monmouth County, New Jersey. Lakewood Closes Tent City In An Humanitarian Way
In an example of government-private cooperation unprecedented in the United States, Tent City located in Lakewood, New Jersey, was closed the right way: through housing. Michael DiCicco, a partner in Bathgate, Wegener & Wolf, P.C., represented Lakewood Township in the litigation that resulted in housing for the residents of Tent City. Rather than litigating to eject the residents from Tent City and force them into other homeless encampments, Lakewood took steps to break the cycle of homelessness. Approximately 120 men and women who participated in a court ordered census and a program to find them housing are now out of the woods and in safe indoor housing for at least one year.
 
Tent City has been the subject of national and international attention as a result of a multi-year court case that Lakewood initiated to close Tent City. Tent City was located off Cedarbridge Avenue in Lakewood and for years served as the home for people with no where else to go. At its height, approximately 150 individuals lived in Tent City. The residents, however, lived in unsanitary and sometimes unsafe conditions in the woods. Lack of running water and electricity, inadequate sanitation, burning of wood and other materials, alcohol and drug abuse were problems confronting the residents. The settlement provides hope and opportunity for the residents of Tent City to live better.

​Brian W. McAlindin Recognized As Certified Civil Trial Attorney
The Supreme Court of New Jersey Board on Attorney Certifications has determined that Brian McAlindin has demonstrated all of the qualifications necessary for recognition as a Certified Civil Trial Attorney.  Mr. McAlindin has met all of the criteria necessary for such designation, including length of admission, extensive and substantial experience, professional reputation, fitness, education and competence to practice as an attorney specializing in Civil Trials.

 Mr. McAlindin is a multi-discipline trial attorney with more than 30 years litigation experience.  He is a graduate of Princeton University and the University of Richmond School of Law. After serving in the Superior Court of New Jersey as law secretary to Hon. Michael J. O’Neil, J.S.C., he practiced with Wilson, Elser, Moskowitz, Edelman & Dicker LLP where he was an equity partner.  Mr. McAlindin joined Bathgate, Wegener & Wolf, P.C. as a partner in 2008 where he continues his litigation practice.  He has extensive trial and appellate experience in personal injury, healthcare liability, employment liability, civil rights suits, construction liability, insurance disputes, premises security liability, mold litigation, toxic torts, intentional torts, property casualty matters and general negligence cases.

​Mr. McAlindin frequently appears and tries cases in the Superior Court of New Jersey and the U.S. District Court for the District of NJ.  He has argued appeals in the Superior Court of New Jersey – Appellate Division, Supreme Court of New Jersey,  and the United States Court of Appeals for the 3rd & 4th Circuits.  Mr. McAlindin is also admitted to practice before the Supreme Court of the United States and the United States Court of Federal Claims. 


William J. Wolf Appellate Specialist
On March 11, 2013, William J. Wolf of Bathgate Wegener & Wolf, P.C., was informed that he has been certified as an Appellate Specialist by the American Institute of Appellate Practice (“AIAP”).  The AIAP is affiliated with the Litigation Counsel of America (“LCA”).  Mr. Wolf is also a fellow of the LCA.  Admission to the LCA is limited to less than one-half of one percent of American lawyers.

According to the AIAP, “Certification as an Appellate Specialist is limited to those select few Litigation Counsel of America Fellows who are accepted by their peers after meeting AIAP’s exceedingly stringent criteria for exceptional competency in the practice of appellate law.”  AIAP concluded that Mr. Wolf’s “… certification as an Appellate Specialist confirms that . . . [he] meet all AIAP’s requirements of extraordinary experience, proven proficiency, and unreachable character!”  Mr. Wolf’s AIAP colleagues have stated that they believe he is “one of the very best of the best in the practice of appellate law.”

Mr. Wolf’s litigation practice is primarily focused on the representation of plaintiffs and defendants in complex commercial litigation.  Mr. Wolf has represented parties in many different types of complex commercial litigation including: stock fraud, consumer fraud, contractual disputes, product liability, intellectual property,  governmental litigation and disputes involving real estate.  Mr. Wolf has tried many cases to conclusion including trials lasting as long as four months.  In conjunction with his active trial practice Mr. Wolf also has an extensive appellate practice which has generated 24 reported decisions.

Mr. Wolf also serves as a mediator for civil litigation cases.  Mr. Wolf limits his mediation practice to the types of civil litigation and disputes that he handles as a litigator. Mr. Wolf provides legal and mediation services throughout the New Jersey/New York metropolitan area including Monmouth County and Ocean County.
