$250,000 Recovery for Cut Finger
Senior Litigation Partner, Edward Kasselman, represented a local pediatrician in her claim against a supermarket (confidentiality must be maintained, per terms of settlement) in Ocean County. As our client was reaching for a package of bacon, the sharp edge of a stainless shelf cut her middle finger. A tendon was partially cut, and she developed slight “triggering” of two fingers, requiring a splint and physical therapy. Dr. “Doe” compensated in her work by using her left hand more than her right. However, there was no surgery and no claim for lost income.
Through close cooperation with her doctors, and by utilizing the services of an expert in upper extremity ergonomics, Mr. Kasselman obtained detailed reports which persuaded the manufacturer of the shelving, and the supermarket, to contribute to a $250,000 settlement before trial. The case required seven depositions, multiple conferences, and a mediation, but our client was pleased with the result which provided full and fair compensation for her injury, while avoiding a jury trial.
